1) Scope of Application
1.1 These General Terms and Conditions (hereinafter "GTC") of WOLFGANGS GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods concluded by a consumer or business (hereinafter "Customer") with the Seller regarding the goods displayed in the Seller’s online shop. The inclusion of the Customer's own terms is hereby rejected, unless otherwise agreed.
1.2 These GTC also apply accordingly to contracts for the delivery of vouchers, unless otherwise specifically regulated.
1.3 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.
1.4 An entrepreneur within the meaning of these GTC is a natural or legal person or a legal partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.
2) Conclusion of Contract
2.1 The product descriptions in the Seller's online shop do not constitute binding offers on the part of the Seller but serve for the submission of a binding offer by the Customer.
2.2 The Customer can submit an offer via the online order form integrated into the Seller’s online shop. After placing selected goods into the virtual shopping cart and completing the electronic order process, the Customer submits a legally binding offer to purchase the goods in the shopping cart by clicking the button that concludes the order. Alternatively, the Customer may also submit the offer to the Seller via email.
2.3 The Seller may accept the Customer’s offer within five days by:

sending a written order confirmation or one in text form (fax or email), with receipt by the Customer being decisive,
-
delivering the ordered goods, with receipt by the Customer being decisive,
-
or requesting payment from the Customer after placing the order.
If multiple of the above alternatives exist, the contract is concluded when the first of these occurs. The acceptance period begins the day after the Customer sends the offer and ends at the close of the fifth day thereafter. If the Seller does not accept the Customer’s offer within this period, it is considered a rejection and the Customer is no longer bound to their declaration of intent.
2.4 If a PayPal payment method is selected, the transaction is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., under their terms and conditions. By selecting a PayPal payment method, the Seller already declares acceptance of the Customer’s offer at the time the Customer clicks the order completion button.
2.5 When submitting an offer via the Seller’s order form, the contract text is saved and sent to the Customer in text form (e.g., email) after the order. No further access to the contract text is provided by the Seller. If the Customer has created a user account, they may access the order data through their password-protected account.
2.6 Before final submission of the order, the Customer can identify and correct input errors by carefully reviewing the information displayed. The browser’s zoom function may help identify errors. Inputs can be corrected using standard keyboard and mouse functions until the order is submitted.
2.7 Only the German language is available for contract conclusion.
2.8 Order processing and communication are generally done via email and automated order systems. The Customer must ensure that the email address provided is accurate and that emails from the Seller can be received, including by checking spam filters.
2.9 For contracts involving weapons, the following additional conditions apply:
2.9.1 For goods covered by the German Weapons Act (WaffG), the Customer must be at least 18 years old. For weapons requiring a license under Annex 2 of the WaffG, a valid acquisition permit is required. The product page will indicate when such laws apply.
2.9.2 By placing an order for restricted items, the Customer confirms they are over 18 and that their name and address are accurate. The Customer also confirms that they will personally receive the goods. Delivery is only made after successful age verification.
2.9.3 For items requiring a permit, a valid acquisition license must be provided (original or officially certified copy). Delivery occurs only after successful age verification and authentication.
3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information on the right of withdrawal is available in the Seller’s withdrawal policy.
4) Prices and Payment Terms
4.1 Unless otherwise stated, the prices listed include statutory VAT. Additional delivery and shipping charges are stated separately.
4.2 Available payment methods are listed in the Seller’s online shop.
4.3 Payment Provider: If the Customer selects a payment method via Viva Wallet, the transaction is processed by VIVA PAYMENT SERVICES SINGLE MEMBER S.A., Amarousiou Halandriou 18-20, 151 25 Maroussi, Attica, Greece. Viva Wallet offers digital payment services. For more details, refer to our Privacy Policy or Viva Wallet Terms and Conditions.
5) Delivery and Shipping Conditions
5.1 If the Seller offers shipping, delivery is made within the delivery area specified by the Seller to the delivery address provided by the Customer, unless otherwise agreed. The delivery address specified in the Seller’s order processing system is decisive for the transaction.
5.2 If delivery fails for reasons attributable to the Customer, the Customer shall bear the reasonable costs incurred by the Seller as a result. This does not apply to the shipping costs if the Customer effectively exercises their right of withdrawal. In the event of a valid withdrawal, the return costs are governed by the Seller’s withdrawal policy.
5.3 If the Customer is acting as a business, the risk of accidental loss and accidental deterioration of the sold goods passes to the Customer upon handover to the shipper, carrier, or other person or institution designated to carry out the shipment. If the Customer is a consumer, the risk of accidental loss and deterioration passes to the Customer upon delivery of the goods. By way of exception, the risk passes to the Customer, even if they are a consumer, once the Seller has handed over the goods to the shipper or carrier, provided that the Customer has commissioned the shipment and the Seller has not previously named this party to the Customer.
5.4 The Seller reserves the right to withdraw from the contract in case of incorrect or improper self-supply. This applies only if the Seller is not responsible for the non-delivery and has concluded a proper covering transaction with the supplier. The Seller shall make all reasonable efforts to obtain the goods. In the event of unavailability or only partial availability, the Customer will be informed immediately, and any consideration already paid will be refunded without delay.
5.5 Pickup by the Customer is not possible for logistical reasons.
6) Retention of Title
If the Seller provides goods in advance, ownership shall not pass to the Customer until full payment of the purchase price has been made.
7) Liability for Defects (Warranty)
7.1 Unless otherwise stipulated, the statutory provisions on liability for defects apply. Deviating from this:
7.2 If the Customer is a business:

The Seller has the choice of how to remedy the defect.

The limitation period for defects in new goods is one year from delivery.

Rights and claims due to defects in used goods are excluded.

The limitation period does not restart in case of replacement delivery under the warranty.
7.3 The limitations and reductions in this section do not apply:

to claims for damages or reimbursement of expenses by the Customer,
-
if the Seller has fraudulently concealed the defect,
-
to goods that have been used for a building in accordance with their usual purpose and have caused its defectiveness,
-
to any obligation of the Seller to provide updates for digital products under contracts for the supply of goods with digital elements.
7.4 For businesses, statutory limitation periods for any existing statutory right of recourse remain unaffected.
7.5 If the Customer is a merchant as defined by § 1 HGB (German Commercial Code), they are subject to the commercial duty to inspect and report defects under § 377 HGB. If this obligation is not fulfilled, the goods are deemed accepted.
7.6 If the Customer is a consumer, they are kindly asked to report obvious transport damage to the carrier and notify the Seller accordingly. Failure to do so does not affect the Customer’s legal or contractual warranty claims.
8) Age Restriction and Age Verification
8.1 Scope: In accordance with legal regulations, especially the German Weapons Act (WaffG), the sale of certain knives in our online shop is subject to age restrictions. These products may only be purchased by persons over the age of 18. This measure is intended to prevent minors from accessing age-restricted knives.
8.2 Website Age Checks: To ensure compliance, we conduct age verification during checkout. This may include a binding age confirmation checkbox for relevant products.
8.3 Additional Verification: We reserve the right to carry out further age verification, including requesting a valid ID (e.g., personal ID card). Delivery of such goods takes place only after successful age verification.

8.5 Legal Consequences: In case of false statements or attempts to bypass the age check, we reserve the right to cancel the contract and take legal action.
8.6 Customer Responsibility: By placing an order, you confirm that you understand and will comply with all legal requirements regarding age restrictions and related laws in the Federal Republic of Germany, including the Weapons Act (§42 WaffG).
9) Special Conditions for the Processing of Goods According to Customer Specifications
9.1 If the Seller is also obliged, under the terms of the contract, to process the goods according to specific requirements of the Customer, the Customer must provide the Seller with all necessary content such as text, images, or graphics in the formats, layouts, and file sizes specified by the Seller and grant the corresponding rights of use. The Customer alone is responsible for acquiring the necessary rights to these contents. The Customer affirms that they hold the rights to use the materials provided to the Seller. In particular, the Customer shall ensure that no third-party rights are infringed, including copyrights, trademarks, or personality rights.
9.2 The Customer indemnifies the Seller from any third-party claims arising from a breach of their rights through the contractual use of the Customer's content by the Seller. The Customer also assumes the reasonable legal costs incurred for the Seller’s legal defense, including court and attorney fees at statutory rates. This does not apply if the Customer is not responsible for the legal violation. In the event of a third-party claim, the Customer is obliged to promptly, truthfully, and fully provide the Seller with all information necessary for assessing and defending the claim.
9.3 The Seller reserves the right to reject processing orders if the content submitted by the Customer violates applicable laws or public decency. This applies in particular to content that is unconstitutional, racist, xenophobic, discriminatory, offensive, harmful to minors, or glorifies violence.
10) Redemption of Promotional Vouchers
10.1 Vouchers issued free of charge by the Seller as part of promotional campaigns, which cannot be purchased by the Customer (hereinafter "promotional vouchers"), are redeemable only in the Seller’s online shop and only within the specified period.
10.2 Specific products may be excluded from the promotion if so stated in the voucher’s terms.
10.3 Promotional vouchers must be redeemed before completing the order process. Retrospective application is not possible.
10.4 Only one promotional voucher may be redeemed per order.
10.5 The value of the goods must at least equal the value of the promotional voucher. Any remaining balance will not be refunded.
10.6 If the voucher value is insufficient, the difference can be paid using another payment method offered by the Seller.
10.7 Promotional vouchers cannot be exchanged for cash or bear interest.
10.8 If the Customer returns goods paid wholly or partly with a promotional voucher as part of their legal right of withdrawal, the voucher will not be refunded.
10.9 Promotional vouchers are transferable. The Seller can make payments with releasing effect to the holder of the voucher who redeems it in the online shop, unless the Seller is aware or grossly negligent in not knowing that the holder is unauthorized, incapable, or lacks legal representation.
11) Redemption of Gift Vouchers
11.1 Vouchers that can be purchased via the Seller’s online shop (hereinafter “gift vouchers”) may only be redeemed there, unless otherwise stated on the voucher.
11.2 Gift vouchers and remaining balances can be redeemed until the end of the third year following the year in which the voucher was purchased. Unused balances will be credited until the expiration date.
11.3 Gift vouchers must be redeemed before completing the order process. Retrospective application is not possible.
11.4 Multiple gift vouchers may be used for a single order.
11.5 Gift vouchers can only be used to purchase goods and not to buy additional gift vouchers.
11.6 If the order amount exceeds the value of the gift voucher, the difference can be paid using another payment method offered by the Seller.
11.7 The balance of a gift voucher will not be paid out in cash nor accrue interest.
11.8 The gift voucher is intended for use by the person named on it. Transfer to third parties is not permitted. The Seller is entitled, but not obligated, to verify the material entitlement of the respective voucher holder.
12) Applicable Law
The laws of the Federal Republic of Germany apply to all legal relationships between the parties, excluding the laws governing the international sale of goods. For consumers, this choice of law applies only to the extent that the protection afforded by mandatory legal provisions of the state in which the consumer has their habitual residence is not withdrawn.
13) Jurisdiction
If the Customer is a merchant, a legal entity under public law, or a special fund under public law with its registered office in Germany, the exclusive place of jurisdiction for all disputes under this contract is the Seller’s business location. If the Customer is located outside Germany, the Seller’s business location shall also be the exclusive jurisdiction, provided that the contract or claims arising from the contract relate to the Customer’s professional or commercial activity. In any case, the Seller is also entitled to bring an action at the Customer’s place of business.
14) Alternative Dispute Resolution
14.1 The EU Commission provides a platform for online dispute resolution (ODR), available at: https://ec.europa.eu/consumers/odr
This platform serves as a point of entry for out-of-court resolution of disputes arising from online purchase or service contracts involving consumers.
14.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
